What is a products liability claim?

A products liability or defective product claim is based on the following:

1.  The crib bumper was defectively designed;

2.  The crib bumper was defectively made; or

3.  The manufacturer of the crib bumper failed to warn of dangers associated with the bumper's expected and normal use.

Must I prove my child’s injuries were caused by the product?

Yes.  To prevail on a products liability claim, one must also show that the defective product was the cause of the injury or death and the person sustained compensatory damages.  Therefore, one must show that the injuries or death were directly caused by the crib bumper.

What is wrongful death claim?

A wrongful death claim generally consists of four elements:

  1. The death was caused, in whole or part, by the conduct of the defendant;

  2. The defendant was negligent or strictly liable for the victim’s death;

  3. There is a surviving spouse, parents, children, beneficiaries or dependents; and

  4. Monetary damages have resulted from the victim’s death.
