Driver Negligence

The majority of car accidents are due to driver negligence.  Drivers may simply be ignoring traffic laws, or may be an improperly trained or licensed driver.

Licenses Required for all Automobile Drivers

In Texas, a driver’s license is required to operate any motor vehicle.  In order to obtain a Texas driver’s license, one must pass a written test covering traffic safety, as well as a vision exam.  In addition, certain individuals must also take a physical driving test with an instructor.

Driver’s licenses are valid for six years.  However, persons 85 and older must now renew their licenses every two years.  In addition, though most renewals can be done online or in the mail, a new law requires persons 85 and older to renew their licenses in person.

Driver Negligence

Many types of driver errors can lead to car accidents, such as:

  • Driver fatigue

  • Speeding

  • Drunk driving

  • Driving under the influence of drugs

  • Lane changes without signaling

  • Forcing a vehicle off the shoulder

  • Running a red light or stop sign

  • Calling or texting while driving

  • Inattention

  • Following too closely (tailgating)
