What is the Personal Injury Lawsuit Process?

Could ERISA reduce my claim recovery?

The Employee Retirement Income Security Act of 1974, known as "ERISA", is a federal law that may allow your insurance company, or your employer's health plan, to recover its costs on your claim, from a settlement or trial verdict award you may receive as a result of a personal injury lawsuit. This is known as "subrogation", and is considered to be a complex area of law. Potential subrogation interests should be discussed with your personal injury attorney after his/her review of any subrogation clauses in your insurance policy or your employer's health plan provisions.

What information will my attorney need from me?

When you or a loved one have been injured in any type of accident it is important to keep extensive documentation of the incident and your injuries. Your personal injury attorney will interact with insurance companies and defense attorneys on your behalf, and in order to make a proper claim for all the benefits you are entitled to, this documentation is necessary.

Warning : Topamax Lawsuit

By: Justin Demerath
Persons who took anti-convulsants should be aware of a recent Topamax lawsuit.  Topamax is an anti-convulsant drug used for the prevention of epileptic seizures and migraine headaches.  Topamax was also sold under the trade name Topiragen.Topamax doesn’t actually treat migraines and seizures, but rather prevents them from occurring by calming overexcited neurons.  These over-stimulated cells can lead to a seizure or a migraine cascade, if not timely soothed.  Topamax pacifies these cells, reducing the occurrence of migraines or seizures.Recent studies have shown that Topamax, if taken prenatally, can cause serious birth defects.  Women taking Topamax during pregnancy have an 11 times greater risk of congenital birth defects, such as cleft lip and cleft palate.Due to these dangerous side effects, the Food and Drug Administration recently increased the pregnancy warning on Topamax to Category D, which means there is positive evidence of human fetal risk.  The warning was issued on March 4, 2011.A pharmaceutical claim is a type of product liability claim in which a person is injured as the result of taking a medication or using a pharmaceutical product.  As a result of these insufficient warnings, persons who took the anti-convulsant drug may be eligible to file a Topamax lawsuit.  If you or someone you know has taken Topamax, you should contact an experienced Topamax lawyer to assist you with your potential claim.
