Frequently Asked Questions

What is a crib bumper exactly?

Crib bumpers are used to line the inside of a crib, softening the walls and providing a barrier between the baby and the crib rails.  Crib bumpers are generally made of polyester-filled cotton, and are affixed to the crib slats by fabric ties or Velcro straps.

What types of crib products qualify for my claim?

Products that line the internal walls of a crib, generally attached by Velcro strips or fabric ties, may fall within the bumper category.  Brands such as Carters © and Circo © are common crib bumper brands.  However, any suspicious products that may have resulted in injury or death may have a viable cause of action.

How do I know if my baby asphyxiated or suffocated due to the bumper?

Symptoms of asphyxiation or suffocation include burst blood vessels in the eyes and a blue (cyanic) coloring of the skin.  An autopsy by a medical professional can diagnose asphyxiation by swollen lungs, or the presence of blood in the nose and mouth.

What should I do if I think I my infant was killed or injured by a defective product?

You should contact O’Hanlon, McCollom & Demerath immediately.  You should also save the defective product, including any packaging and operating instructions.  If your child is injured, you should get immediate medical attention and follow your doctor's instructions.  If your child is killed, you should request an autopsy to determine the exact cause of death.  Finally, you should contact the Consumer Products Safety Commission at 800-638-2772.
