The Texas Dram Shop Act holds a "provider" of alcohol liable for any harm or injury caused by serving an alcoholic beverage to a patron who is "obviously intoxicated". Drunk Drivers Lacking Insurance

Drunken drivers are clearly irresponsible, and therefore sometimes do not have Texas automobile insurance. Texas Supreme Court Decision

Under a recent Texas Supreme Court decision, if a claimant is harmed by a drunk driver and the jury finds that a club, bar or store is responsible for the drunk driver's intoxicated condition, then the provider of spirits may be held responsible for the plaintiff's injuries. In other words, innocent victims of drunk drivers may have the ability to collect 100% of any damages awarded due to the drunk driver's negligence directly from the provider of the alcohol.
